By engaging Tender Collector LLC ('Company') for services, you ('Client') agree to these Terms of Service. These terms govern all service agreements between the Company and Client.
Tender Collector provides done-for-you outbound marketing services including email campaigns, LinkedIn outreach, lead research, and CRM management for freight brokers and carriers. Specific deliverables are outlined in each Client's service agreement.
Services are billed monthly. A one-time setup fee of $500 per seat is due upon onboarding. Monthly retainers are due on the first of each month. Late payments may result in suspension of services.
If the Client's campaign reply rate falls below 3% in any month within the last six months of their active campaign, the Client is entitled to a 50% refund for each qualifying month upon cancellation. Reply rate is calculated based on deliverable contacts only — excluding bounced emails and inactive LinkedIn accounts.
Client may cancel services at any time with written notice to hello@tendercollector.com. Cancellation takes effect at the end of the current billing month. Refunds per Section 4 will be processed within 14 business days of cancellation.
Client agrees to provide accurate ICP information, timely feedback on campaigns, and access to required accounts (LinkedIn, email domains) as needed. Client is responsible for closing conversations generated by Tender Collector's campaigns.
Both parties agree to keep all business information, campaign data, and client details confidential and not disclose to third parties.
Tender Collector is not responsible for Client's failure to close leads, market conditions affecting reply rates, or outcomes beyond our direct control. Our total liability shall not exceed the monthly retainer paid in the most recent billing period.
All campaign copy, lead lists, and materials created by Tender Collector remain the property of Tender Collector until full payment is received, after which they transfer to the Client.
These terms are governed by the laws of the Commonwealth of Pennsylvania.
